I'm not sure if this error has been posted before or not, but I've run into it several times down in the mines.

I am a playing as a brigand and I initiated the attack.

Thanks for the post.  We have fixed this and it should be better in the update when it ks released.  For now, just for that type of enemy, don't initiate the combat.
